1. INFORMATION FOR THE USER
Who is responsible for processing your personal data?
Associació Clúster de la Bioenergia de Catalunya is the DATA CONTROLLER of the USER’s personal data and informs that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and the Organic Law 3/2018, of 5 December (LOPDGDD).
Why do we process your personal data?
To maintain a business relationship with the USER. The operations envisaged for processing are:
- Sending commercial advertising communications by e-mail, fax, SMS, MMS, social networks or any other electronic or physical means, present or future, that allows commercial communications. These communications must be made by the DATA CONTROLLER and are related to their products and services, or with their collaborators or suppliers with whom a promotional agreement has been reached. In this case, third parties will never have access to personal data.
- Sending the online newsletter about news, offers, and promotions related to our activity.
- Conducting market research and statistical analyses.
- Processing orders, responding to inquiries, or any type of request made by the USER through any of the contact methods available on the DATA CONTROLLER’s website.
- Internal research and development of the products and services we offer.
- Managing data provided by candidates for a job position through the Curriculum Vitae (CV) submitted for selection and recruitment purposes.
- It is also possible that we use personal information to comply with internal and external audit requirements and in any other way we consider necessary or appropriate: (a) under applicable law, (b) to respond to requests from courts, security agencies, regulatory bodies, and other public authorities, (c) to comply with our terms and conditions, and (d) to protect our rights, privacy, security, or property, or those of others.
- Managing our activities, administration, and relationships with our members.
On what grounds can we process your personal data?
Because processing is legitimized under Article 6 of the GDPR as follows:
- With the user’s consent: sending commercial communications, newsletters, and job application processing.
- For the legitimate interest of the DATA CONTROLLER: conducting market research, statistical analyses, etc., and processing orders, requests, etc. at the USER’s request.
- By legal obligation: for audit, internal and external control, and member management.
How long will we keep your personal data?
Data will not be retained longer than necessary to fulfill the purpose of processing or while there are legal prescriptions requiring custody, and when no longer needed, they will be deleted using appropriate security measures to ensure anonymization or complete destruction.
Who do we share your personal data with?
No personal data will be communicated to third parties except, if necessary for the development and execution of processing purposes, to our service providers related to communications, with whom the DATA CONTROLLER has formalized confidentiality and data processing agreements required by current privacy law.
What are your rights?
The USER has the following rights:
- Right to withdraw consent at any time.
- Right of access, rectification, portability, and deletion of data, as well as restriction or objection to processing.
- Right to file a complaint with the supervisory authority (www.aepd.es) if they consider the processing does not comply with applicable law.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER
By checking the corresponding boxes and entering data in the fields, the USER expressly and freely consents that their data are necessary to process their request. The DATA CONTROLLER will indicate which data are required to provide optimal service to the USER. If such data are not provided, there is no guarantee that the information and services offered will fully meet the USER’s needs.
The USER guarantees that the personal data provided to the DATA CONTROLLER are true and is responsible for communicating any changes.
3. SECURITY MEASURES
In accordance with current personal data protection regulations, the DATA CONTROLLER complies with all GDPR and LOPDGDD provisions regarding the processing of personal data under its responsibility, and explicitly with the principles described in Article 5 of the GDPR, ensuring that data are processed lawfully, fairly, and transparently, and are adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed.
The DATA CONTROLLER ensures that appropriate technical and organizational policies have been implemented to apply the security measures established by the GDPR and LOPDGDD to protect the rights and freedoms of USERS and has provided them with adequate information to exercise those rights.
